1 Project financing in nuclear new build, why not? The legal and regulatory barriers

This paper investigates the legal barriers to apply project finance for building nuclear power plants. Countries such as the UK, Turkey and emerging economies (i.e. Malaysia and Indonesia) are increasingly seeking to attract private investors for nuclear projects using project finance. This is an innovative approach, and until now the only cases registered are Hinckley Point C in the UK and Akkuyu in Turkey. This paper scrutinises the mismatches between the requirements of project finance and nuclear law. Nuclear law introduces specific requirements affecting the security interest of private lenders, hindering the bankability of nuclear projects on a non-recourse basis. The paper emphasises that the performance-based regulatory approach is more compatible with project finance compared to the prescriptive based one. Furthermore, the paper examines the gaps between nuclear and holistic energy law, looking at the financing of energy infrastructures. Improving nuclear law enables to apply project finance to nuclear power plants, facilitating their deployment. Consequently, nuclear law plays a central role in promoting sustainable energy mixes characterised by reduced carbon emissions.

2 A worlds dilemma `upon which the sun never sets - The nuclear waste management strategy (part I): Western European Nation States and the United States of America

The management of spent nuclear fuel (SNF) and nuclear wastes demands a strategy to provide for the safe, secure, and permanent disposal of radioactive material from power generation, defense uses, and other activities. Nation states have taken different paths to nuclear waste management and are at various stages of the development of a nuclear waste management strategy. A strategy may include developing a geological repository, nuclear fuel reprocessing, interim storage, as well as discussions of the creation of a multinational storage facility. The nation states have each developed (or are developing) a set of laws and regulations for the management of SNF and nuclear wastes within a constitutional framework and regulatory space. The paper provides an overview of the strategy used (or being developed) and its place within the legal framework. The paper concludes that though each nation state must look outward to its shared international obligations, there must also be an inward reflection of a nation state to its own traditions, customs, and legal/law making regimes. This is to assure a successful and stable outcome at the present period of time, and into the future.© 2016 Elsevier Ltd. All rights reserved.

3 The global nuclear liability regime post Fukushima Daiichi

Nuclear liability regimes are important as they ensure that potential victims will be compensated promptly and efficiently after a nuclear accident. The accident at Fukushima Daiichi in Japan in 2011 prompted a review of the global nuclear liability regime that remains on-going. Progress has been slow, but over the next few years the European Union is set to announce its new proposals. Meanwhile, in 2015, another global nuclear liability regime, the Convention on Supplementary Compensation for Nu- clear Damage, has entered into force. This paper aims to move the debate in the literature on nuclear liability and focuses on the four following major issues: (1) reviews third-party nuclear liability regimes currently in operation around the world; (2) analyses the international nuclear liability regime following the accident at Fukushima Daiichi; (3) comparatively assesses the liability regimes for nuclear energy and the non-nuclear energy sector; and (4) presents the future outlook for possible developments in the global nuclear liability regime.© 2016 The Authors.
